Terms of Service

1. Acceptance of Terms

By creating an account or using BrikTech ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BrikTech is a construction job management platform that enables builders and tradespeople to manage jobs, tasks, shopping lists, client communications, and integrations with third-party services including Google Calendar and Xero. The Service also includes AI-assisted features such as a voice assistant and automated selection extraction.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access to your account.

4. Subscription, Billing and Cancellation

BrikTech is offered on a paid subscription basis with the following terms:

  • Pricing — current plans and prices are shown on our pricing page. We may change pricing on renewal with at least 30 days' notice.
  • Free trial — new accounts may receive a 14-day free trial. You will not be charged during the trial. At the end of the trial, your subscription begins automatically unless you cancel before the trial ends.
  • Billing cycle — subscriptions are billed monthly in advance and renew automatically until cancelled.
  • Cancellation — you may cancel at any time from your billing settings. Cancellation takes effect at the end of your current billing period; you retain access until that date.
  • Refunds — payments are non-refundable. We do not pro-rate refunds for partial months.
  • Failed payments — if a payment fails, we will attempt to retry per Stripe's standard dunning. If payment cannot be collected, access to the Service may be suspended. Your data is retained so you can reactivate by updating payment details.
  • Taxes — prices are inclusive of GST where applicable.

Payment processing is handled by Stripe; their terms apply to the payment transaction itself.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that infringes intellectual property rights
  • Attempt to gain unauthorised access to other accounts or systems
  • Upload malicious code or files
  • Use the Service to harass, abuse, or harm others
  • Use automated means (bots, scripts) to abuse our APIs or interfere with service operation

6. Your Content

You retain ownership of all content you upload to BrikTech (photos, notes, job data). By uploading content, you grant us a limited licence to store, transmit, and display that content as necessary to provide the Service to you.

You are responsible for ensuring you have the right to upload any content, including photos of work sites and client properties.

7. AI-Assisted Features

BrikTech includes features that send your content to third-party AI services to provide functionality:

  • Voice assistant — audio you record using the in-app microphone is transmitted to OpenAI for transcription and intent recognition. The interpreted actions are presented to you for review before any change is made to your data.
  • Document extraction — quote documents and similar uploads may be sent to OpenAI to extract selections automatically.

AI-generated suggestions are not guaranteed to be accurate. You are responsible for reviewing AI-suggested changes before confirming them.

8. Third-Party Integrations

Connecting third-party services (Google Calendar, Xero) is optional. When connected, those services are governed by their own terms and privacy policies. We are not responsible for the availability or accuracy of those services.

9. Service Availability

We aim to provide reliable access to BrikTech but do not guarantee uninterrupted availability. We may perform maintenance that temporarily affects access. We are not liable for losses arising from downtime.

10. Limitation of Liability

To the maximum extent permitted by Australian law, BrikTech is provided "as is" without warranty. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of business data.

Our total liability for any claim is limited to the amount you have paid us in the 12 months preceding the claim.

11. Data and Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms.

12. Termination

You may delete your account at any time from your Profile page. Deleting your account does not automatically cancel your company subscription if you are a company administrator; you must cancel the subscription separately from billing settings before deleting your account, or promote another team member to administrator.

We reserve the right to suspend or terminate accounts that breach these Terms.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of NSW courts.
